Many who suffered damage as a result of a traffic accident in Germany, or rather who suffered damage in Germany, are trying to handle their claim on their own.

However, you can delegate this work without incurring any costs that will be charged to you directly because costs for an attorney are, as are costs for a consulted expert, part of the damage and must be paid by the liability insurance of the person who caused the accident. This is valid, if the liability quota of the opposing insurance is 100%, meaning that the opposing insurance company must assume complete liability for the entire damage. Nevertheless, many companies, especially in the transportation trade, are taking it upon themselves to employ a person who handles liability claims exclusively.

In the USA you can read in the yellow pages that attorneys handle accident cases without any charges to their clients: Personal injury – accident – nursery abuse = no costs. In Germany this kind of advertising on the part of attorneys is not allowed and for this reason many people are not informed of the fact that costs for legal representation are considered part of the damage.

However, the problem is the quota i.e. the percentage of the liability. In case the insurance does not assume full liability, for instance 50% only, due to partial responsibility or a danger that has to be taken into account because of the use of the vehicle, then the opposing insurance only pays 50% of the attorney’s fees. Therefore, the attorney can only claim his fee based on the amount obtained from and paid by the liability insurance.

In case you wish to receive more than that, you will have to issue a specific order to the attorney for putting in a claim for the rest of the amount. This will then incur a fee which, if the case is lost, will have to be paid by you, or perhaps by your legal protection insurance.
